The Unfair Claims Settlement Practices Act (R.I. Gen. Laws § 27-9.1-4) was enacted to ensure that insurance companies handle claims in a fair and timely manner. Here are a few requirements to be wary of:

Time to Respond – Your insurer must respond to your claim within 30 days (unless you agree to a longer period of time to respond). § 27-9.1-4(a)(16).

Request for Forms – If you request forms to file your claim, your insurer must provide these forms within 10 calendar days and must explain how to use them. § 27-9.1-4(a)(13).

Reasonable Promptness – Your insurer must acknowledge your claim and respond to your communications promptly.  § 27-9.1-4(a)(2).

Prompt Investigation – Your insurer must promptly investigate and settle claims under its policies. § 27-9.1-4(a)(3).

Prompt Settlement – Your insurer must act in good faith to promptly, fairly, and equitably settle claims when liability has become reasonably clear. § 27-9.1-4(a)(4).

Reasonable Investigation – Your insurer cannot refuse to pay claims unless it conducts a reasonable investigation. § 27-9.1-4(a)(6).

Reasonable Time – Your insurer must confirm or deny coverage of your claim within a reasonable time after it completes its investigation. § 27-9.1-4(a)(7).
